Terms of Service

These Terms of Service (“Terms”) govern your access to and use of PromptFlix websites, applications, and related services (the “Service”).
PromptFlix provides tools to add talent (face and voice packs for yourself and others with permission), cast them into film roles, generate personalized videos, stream them privately, and optionally publish to YouTube.
“We” / “us” / “our” means the operator of PromptFlix. “You” means the person or organization using the Service.
Please read these Terms carefully. By accessing or using the Service, creating an account, purchasing credits, or completing a checkout, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Acceptance and changes
We may modify these Terms when we add features, change billing, or update legal requirements. Changes are effective when posted on this page (see the date above), or earlier if you accept them through an in-product notice.
You are responsible for reviewing this page periodically. Continued use after revised Terms take effect constitutes acceptance, except where mandatory law requires a different standard.
2. Privacy
Our collection and use of personal data—including talent media (photos and voice samples), generations, videos, billing metadata, and YouTube connection data—is described in the Privacy Policy. By using the Service you acknowledge those practices.
3. Eligibility and accounts
3.1 Age and capacity
You must be able to form a binding contract and be at least 16 years old (or the higher minimum age in your country). The Service is not intended for children.
3.2 Account responsibilities
When you create an account or sign in (including via email/password or Google), you agree to:
- Provide accurate information and keep it updated
- Keep credentials and connected inboxes secure
- Accept responsibility for activity under your account
- Not share paid access except as we expressly allow
Notify us promptly if you suspect unauthorized access.
We may refuse, suspend, or terminate accounts that violate these Terms or that we reasonably believe pose risk to the Service, other users, or our providers.
3.3 Account deletion
You may request account closure through in-product tools or support. Closure does not automatically erase records we must keep for tax, accounting, fraud prevention, or legal compliance (see Privacy Policy). Paid entitlements end according to product rules when the account is closed, subject to mandatory consumer law.
4. The Service
4.1 What we offer
PromptFlix may provide:
- Upload and storage of talent media (face photos and voice samples) for casting
- A library of movie templates with castable roles
- Casting user talent into roles (uncast roles may use platform default talent)
- Generation jobs that produce personalized videos
- Streaming / hosting of outputs (private by default)
- Optional YouTube publish flows you authorize
- Credits and paid plans (no free tier for generations)
Features, catalogs, pricing, and quality may change. We do not guarantee that any particular template, model, or feature will remain available indefinitely.
4.2 Availability and beta features
We may update, throttle, or discontinue parts of the Service for maintenance, capacity, safety, or product reasons. Some features may be experimental (“beta”) and may be incomplete or unreliable.
4.3 No professional advice; results vary
Outputs are entertainment / creative tools. Results depend on input quality, template design, model behavior, and third-party infrastructure. We do not guarantee photorealism, identity match, continuous availability, or fitness for a particular commercial purpose.
5. Talent, consent, casting, and acceptable use
5.1 Talent media (face and voice)
In PromptFlix, talent means face photos and optional voice samples you add to your account so they can be cast into film roles. You may add multiple people to your cast (for example yourself and friends). Films have roles; you cast talent into those roles. Roles you leave uncast may use platform default talent.
You represent and warrant that:
- You own the rights to media you upload, or you have all consents and licenses needed to use them with the Service (including from every person depicted or recorded)
- If you upload media of another person, you have their prior, informed permission (and any other consent required by law) to use their face and voice for AI generation and distribution you request through PromptFlix
- You will not upload or generate content depicting another person without their permission
- You will not upload or attempt to recreate celebrities, public figures, or other people who have not agreed, or use the Service for unauthorized commercial publicity
- You will not use the Service to create non-consensual intimate imagery, deepfake abuse, impersonation for fraud, harassment, or other unlawful content
The product may ask you to confirm consent when adding talent who is not marked as yourself. Confirmation does not replace legal requirements.
You are solely responsible for obtaining model releases, publicity rights clearances, and platform permissions for any public distribution of outputs.
5.2 Prohibited uses
You must not use the Service to:
- Violate law or third-party rights (privacy, publicity, IP, defamation, etc.)
- Upload talent media of people who have not authorized you (including celebrities and public figures)
- Create or distribute child sexual abuse material or exploit minors
- Harass, threaten, stalk, or incite violence
- Commit fraud, scams, or identity theft
- Attempt to reverse engineer, scrape, overload, or disrupt the Service or its providers
- Circumvent usage limits, billing, or access controls
- Upload malware or attempt unauthorized access to systems or other users’ data
- Use outputs to train competing models in violation of these Terms or applicable law, where restricted
We may remove content, rate-limit, or suspend accounts that violate this section.
5.3 Content moderation
We may review, block, or delete content and generations that appear to violate these Terms or create legal or safety risk, but we have no obligation to monitor all content.
6. Intellectual property
6.1 Our IP
The Service, branding, software, templates, pipelines, documentation, and related materials are owned by us or our licensors. Except for the limited rights granted below, no rights are transferred to you.
6.2 Your inputs
As between you and us, you retain ownership of talent media and other content you upload (“User Content”), subject to the licenses you grant here and third-party rights.
6.3 License you grant us
You grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit, display, and create derivative works from User Content solely to operate and improve the Service (including generation, storage, streaming, support, security, and optional publishing you request).
6.4 Outputs
Subject to these Terms, payment of applicable fees, and third-party rights, we grant you a license to use generated videos for personal or commercial purposes you are otherwise legally allowed to pursue. That license does not include rights to:
- Our templates, software, models, or branding as standalone assets
- Other users’ content
- Third-party music, footage, trademarks, or people depicted in a template beyond the scope of the Service
Template libraries and third-party stock elements may remain licensed only for use through PromptFlix outputs as generated, not for extraction or reuse outside the Service.
6.5 Feedback
If you send ideas or feedback, we may use them without restriction or compensation.
7. Purchases, credits, and subscriptions
7.1 Pricing and checkout
Prices and product descriptions are shown at purchase time. Currency, taxes, and display may depend on the checkout provider and your location.
Checkout is processed by third-party payment providers. You may also be subject to their terms and privacy policies. We do not store full payment card numbers on PromptFlix servers.
7.2 Credits and access
Credits, plans, or entitlements unlock generation or other features as described in the product UI. Credits may be consumed per generation or other metered actions. Unused credits may expire if the product states an expiry; otherwise they remain associated with your account until used or the account is closed, subject to plan rules.
7.3 Subscriptions
If subscriptions are offered, they renew automatically at the then-current price and interval unless you cancel through the billing portal or in-product controls before renewal. Cancellation stops future renewals; it does not always refund the current period unless required by law or stated otherwise.
7.4 Refunds
Digital generations and consumed credits are generally non-refundable once processing has started, except where mandatory consumer law requires otherwise or we choose to provide a goodwill credit. If a paid job fails due to our infrastructure error, we may re-run the job or restore credits at our discretion.
7.5 Chargebacks
Unfounded chargebacks may result in account suspension. Contact support first so we can help resolve billing issues.
8. YouTube and third-party services
Optional YouTube publishing requires you to connect a Google / YouTube account and grant permissions. You are responsible for compliance with YouTube Terms of Service, Google policies, and copyright rules for anything you publish.
We may revoke or break integrations if the third party changes APIs or your tokens expire. Third-party services can go down or change without notice.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that outputs will be accurate, uninterrupted, secure, or free of harmful content, or that defects will be corrected.
Some jurisdictions do not allow certain disclaimers; in those places, disclaimers apply to the fullest extent permitted.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE CLAIM, OR (B) FIFTY EUROS (EUR 50) (or local currency equivalent).
These limits do not apply to liability that cannot be limited under mandatory law (for example certain consumer rights, fraud, or death/personal injury caused by negligence where such exclusion is prohibited).
11. Indemnity
You will defend and indemnify us and our affiliates, officers, and employees against claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your User Content or outputs you distribute; (b) your breach of these Terms; (c) your violation of law or third-party rights, including publicity, privacy, and consent claims related to talent you upload or cast; or (d) your use of YouTube or other third-party services through PromptFlix.
12. Suspension and termination
We may suspend or terminate access immediately if you violate these Terms, create risk, fail to pay, or if we discontinue the Service. You may stop using the Service at any time. Provisions that by nature should survive (including IP, disclaimers, liability limits, indemnity, and governing law) will survive termination.
13. Governing law and disputes
These Terms are governed by the laws applicable to the operator of PromptFlix, without regard to conflict-of-law rules, except that consumers may retain mandatory protections of their country of residence.
Courts or dispute forums will be those with jurisdiction over the operator, unless mandatory consumer law requires otherwise. Before filing a claim, you agree to try to resolve the dispute informally by contacting support.
14. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy are the entire agreement regarding the Service.
- Severability. If a provision is unenforceable, the rest remains in effect.
- No waiver. Failure to enforce a provision is not a waiver.
- Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- Export / sanctions. You must not use the Service in violation of export control or sanctions laws.
- Language. These Terms are provided in English. Localized UI does not change the governing language of this document unless we publish a separate localized legal version.
